Gift Card Terms and Conditions

These terms and conditions (“Terms”) apply to the purchase, use, and redemption of gift cards (“Gift Cards”) issued by Tom Phat  (“we,” “us,” or “our”).

1. Purchase

• Gift Cards can be purchased in person at our restaurant located at 184 Sydney Road, Brunswick or online at https://tomphat.com (if applicable).
• Minimum purchase amount may apply.
• We accept various payment methods for Gift Card purchases, subject to availability (e.g., cash, EFTPOS, major credit cards).
• Gift Cards are purchased for a specific value and cannot be reloaded or topped-up.

2. Activation

• Gift Cards are activated immediately upon purchase at the restaurant or upon confirmation of online purchase.
• You are responsible for safeguarding your Gift Card. We are not liable for lost, stolen, damaged, or misused Gift Cards.

3. Redemption

• Gift Cards can be redeemed for food and beverage purchases at our restaurant location only.
• Gift Cards cannot be redeemed for cash.
• Present your Gift Card at the time of purchase for redemption.
• The purchase amount will be deducted from the Gift Card balance.
• If the purchase exceeds the Gift Card balance, the remaining amount can be paid using another payment method.
• Multiple Gift Cards can be used for a single purchase.

4. Expiry

• Gift Cards are valid for 3 years from the date of purchase.

5. Balance Inquiry

• You can check your Gift Card balance by presenting it at the restaurant or by contacting us at (03) 9121 3377 or eat@tomphat.com.au.

6. Limitation of Liability

• We are not responsible for any unauthorised use of your Gift Card.
• Our liability for any Gift Card is limited to the remaining balance on the card.
• We reserve the right to amend these Terms at any time by posting the revised terms on our website or displaying them at the restaurant.

7. Governing Law

• These Terms are governed by and construed in accordance with the laws of Victoria, Australia.

• We may offer promotional Gift Cards with specific terms and conditions that supersede these Terms.
• You are encouraged to retain a copy of these Terms for your reference.

By purchasing, using, or redeeming a Gift Card, you agree to these Terms.
